Because there is a delay of at least six weeks after the Lasting Power of Attorney (LPA) has been prepared and before it may be legally registered by the Office of the Public Guardian, Steele Rose are offering a General Power of Attorney (for only £66 each) to clients who also require a registered Lasting Power of Attorney (Property and Financial Affairs) so that the power may be used immediately it has been signed and witnessed, thus avoiding any delay and inconvenience during this period. The General Power of Attorney must be requested at the same time instructions are taken for the LPA.
A General Power of Attorney (GPA) is a straightforward authority for use when
the Donor is not available or is physically unable to look after their own affairs.
It can be used to manage or deal with financial affairs jointly or jointly and
severally by the nominated Attorney(s).
Lasting Powers of Attorney (LPA) are more complicated to prepare than
GPAs because they permit the Attorney to make decisions that the Donor
is incapable of making. They require particular procedures and formalities
to be followed.
A GPA is automatically annulled if the Donor becomes mentally incapable
otherwise a GPA remains valid until it is revoked and a GPA may be revoked
by the Donor at any time. The GPA would also be revoked by the death or
bankruptcy of the Donor or Attorney.
Once a General Power is granted the Attorney has the authority to make
decisions on the Donor's behalf in relation to the Donor's property and financial
affairs, as if the Donor were making the decision themselves. There is no
provision for limiting the scope of the Attorney's powers in a General Power.
The GPA does not cover functions of the Donor which relate to certain special personal responsibilities. For example, an Attorney cannot perform in the Donor's role as a trustee or as a personal representative of someone's estate.
The Donor remains liable for the actions of the Attorney and the extent of the Power is such that it should only be given to somebody the Donor trusts completely.

General Powers of Attorney are prepared in accordance with Section 10 of the Powers of Attorney Act 1971 and authorise the Attorney to act on behalf of the Donor concerning their property and financial affairs, providing the Donor has the mental capacity to make decisions for themselves.
Each document bares the company embossed seal.
No further authorisation or registration is required.
